Derecho al olvido en Internet: Google y la doctrina europea

Abstract

Este ensayo desarrolla parte de la problemática moral, social y legal que hay detrás de la justificación y la implementación del llamado derecho al olvido en Internet, según el cual, dadas ciertas circunstancias, los individuos pueden solicitar a un motor de búsqueda la eliminación de algunos enlaces asociados a sus nombres. Se reflexiona sobre el particular a partir de una sentencia emitida por el Tribunal de Justicia de la Unión Europea en mayo de 2014, así como de las recomendaciones del Grupo de Trabajo del artículo 29 sobre protección de datos, la práctica de Google y el informe de su consejo asesor.

Author Biography

  • David Villena-Saldaña, Universidad Nacional Mayor de San Marcos (Perú)
    Licenciado en Filosofía y candidato a magíster en Epistemología. Completó, asimismo, estudios de posgrado en Política. Vicepresidente del Centro de Estudios de Filosofía Analítica. Profesor en las escuelas de Filosofía de la Universidad Nacional Mayor de San Marcos y la Universidad Antonio Ruiz de Montoya. Fue investigador visitante en el Instituto de Filosofía de la Universidad de Leiden (Holanda) durante el semestre 2013-II. Es autor de “El Círculo de Viena. Una nota histórica” (Analítica, 2014), “Julian Assange: Periodismo científico, conspiración y ética hacker” (Quehacer,2011), “Derechos humanos y religión” (La República, 2009), entre otros artículos.
