Human rights and constitution: the silent paradox

This paper will carry out, in the first instance, an analysis on the development and importance of constitutional law for the protection of human rights throughout global and Peru’s history. It will also analyze how civil and constitutional law have developed in our country’s history, to achieve this, it will be necessary to resort to the three civil codes that we have had. Finally, with this research, it will be developed how constitutions throughout the world do not protect human rights in the same way, thus generating a greater question that needs to be answered: Do constitutions truly protect people? or are there situations where their rights are being violated? These questions are brought up because, in principle, human rights are universal and inalienable. Nevertheless, it seems as though people are more unprotected: a problematic that deserves to be talked about and fixed. And although this investigation will not be able to provide a specific solution for each situation or for each country, it will provide questions that will make us analyze the delicate situation we are going through.
