The New Means of Dispute Resolution: The Dispute Boards

This article presents the dispute boards or dispute resolution boards as a new means of dispute resolution provided for in the State Contracting Law and the regulation that promotes private investment through public-private associations, in order to settle disputes arising under a construction contract entered into with the Peruvian Government. The dispute board is a new method for resolving disputes resulting from the execution of government construction projects, and is aimed at finding a rapid dispute resolution. In this way, construction works are not affected by the time for the dispute settlement, thus being able to keep on schedule. The Peruvian Government is committed to this new agile and specialized means of dispute resolution, which has adjudicators and arbitration centers for its organization and administration. As a result, a tripartite contract is entered into between the parties involved in the construction contract, the adjudicators and the administration center.
