The crisis of the concept of capacity under Chilean law: international protection and autonomy of people with intellectual disabilities

This article aims to analyze the legal situation of people with intellectual disabilities under Chilean law, focusing on the regulatory framework, the system adopted by Congress, and the existing contradiction with international treaties that protect the rights of people with disabilities. The work highlights the crisis of the notion of capacity to exercise since the Convention on the Rights of Persons with Disabilities came into force in Chile, mainly based on Article 12. Later it reviews the limitations that Chilean civil law shows and how they violate international provisions and develops the possibility of establishing a differentiated system of autonomy that recognizes the different capacities of people. The article proposes establishing absolute incapacity as a restrictive and exceptional rule, only applicable to cases of complete deprivation of reason, that can coexist with the support mechanisms and safeguards required by international laws.
