Reflections on the electronic manifestation of the will in the Peruvian civil code

This article develops a brief analysis of the manifestation of the will as an essential element of the legal act and how it can be manifested through electronic and telematic means within the Peruvian legal system. In this sense, the article begins with a brief dissertation on the role of the manifestation of the will in the creation of patrimonial legal acts, in order to later present the modifications established by Law No. 27291 to Articles 141 and 1374 of the Peruvian Civil Code, allowing the manifestation of the will by electronic means and introducing the acknowledgement of receipt as a form of reception, as well as the incorporation of Article 141-A regarding the legally required formalities materialized by means of electronic security systems. The author reflects on the arguments raised at the time of the debate on this amendment to the Civil Code and how its approval was crucial for the development of electronic contracting in Peru.
