Abstract

Keeping patient privacy becomes an ethical and legal dilemma for doctors and hospitals when this can cause harm to third parties. This short article aims to study the questions that arise in this regard with reference to patients with COVID-19. To this end, taking into account the jurisprudential and doctrinal guidelines also developed in legal systems other than the Italian, the circumstances that justify the violation of patient confidentiality by doctors are analyzed.
