Reflections on the limits to the powers of arbitrators and the iura novit arbiter

Arbitrators are invested with a series of powers necessary to fulfill the task that the parties, in the exercise of their private autonomy, have entrusted them. However, to the extent that such capacities are not explicit and exhaustive —if they were, the practice of arbitration would be impossible—, arbitrators often face many dilemmas that put the validity and enforceability of the award at risk. These dilemmas are more complex when they do not concern procedural issues only but involve decisions that will inevitably affect the substance of the dispute. In this context, establishing the parameters for an adequate understanding of the limits for the exercise of implicit powers held by arbitrators constitutes an essential task for the development and growth of arbitration practice.
